What are the penalties for Public Intoxication in Kentucky?
Public Intoxication is a Class B misdemeanor in Kentucky and carries a sentence of up to 90 days in jail. It can also carry a fine of up to $250.00.
What are the penalties for Alcohol Intoxication in Kentucky?
Alcohol Intoxication is a violation in Kentucky and carries a fine of not less than $25.00.
For third or greater offenses within a twelve (12) month period, alcohol intoxication can carry a fine of up to $100.00 and sentence of up to ninety (90) days in jail.

(1) A person is guilty of public intoxication when he appears in a public place manifestly under the influence of a controlled substance, or other intoxicating substance, excluding alcohol (unless the alcohol is present in combination with any of the above), not therapeutically administered, to the degree that he may endanger himself or other persons or property, or unreasonably annoy persons in his vicinity.
(2) Public intoxication is a Class B misdemeanor.
