Kentucky Robbery Crimes
The word “robbery” is often used interchangeably with “theft.” It is important to know the difference between these two terms. In Kentucky all robberies are thefts, but not all thefts are robberies. The distinction between the two is that robberies are thefts committed by the use or threat of force. The degree of the robbery depends on the type of threat or use of force.
These distinctions are best described by use of a simple hypothetical:
1) If a person steals a pack of gum from a grocery store, that is theft.
2) If a person steals a pack of gum from a grocery store while threatening to beat up the cashier – that is second degree robbery.
3) If the person steals a pack of gum from a grocery store while pulling a gun on the cashier and threatening to shoot him – that is first degree robbery.
In Kentucky, robbery is illegal and is always a felony.
-
Robbery in the First Degree is a Class B felony.
-
Robbery in the Second Degree is a Class C felony.
