One of the most common misconceptions about burglary is the belief that it involves theft. This is incorrect. In fact, Kentucky’s burglary statute makes absolutely no mention of theft. The severity of the burglary charge will depend on two main factors –
1) The first factor is the type of building that is entered. If the building is simply a public building, the penalty is far less harsh than if the building is a person’s dwelling.
2) The second factor looks at what actually occurred during the burglary itself. If the suspect was armed, threatened the victim or injured the victim, the penalties are significantly more harsh.
